Eisenbahnunternehmen müssen ihren Kunden bei Verspätungen auch dann Fahrpreise teilweise erstatten, wenn höhere Gewalt der Grund der Verspätung ist. Das entschied heute der Europäische Gerichtshof.
Bahnreisende haben auch bei höherer Gewalt, z.B. Unwetter oder Streik, Anspruch auf Entschädigung für Verspätungen. Reisende haben laut EU-Gesetz bei Verspätungen von ein bis zwei Stunden ein Recht auf Erstattung von mindestens einem Viertel des Preises der Fahrkarte. Ab einer Verspätung von zwei Stunden müssen die Bahnunternehmen mindestens die Hälfte des Preises erstatten.
Dies solle keine Bestrafung für den Unternehmer sein, sondern den Preis kompensieren, welchen der Fahrgast als Gegenleistung für eine nicht vertragsgemäße Leistung erbracht hat.
Die Deutsche Bahn reagierte positiv auf die Entscheidung des Europäischen Gerichtshofs.
Ein Vergleich mit den Rechten von Passagieren im Flug-, Schiffs- oder Busverkehr sei jedoch nicht angebracht, so die Luxemburger Richter. Diese Verkehrsformen seien nicht mit dem Bahnverkehr vergleichbar.
Das Urteil betrifft europaweit alle Bahnunternehmen. Klauseln innerhalb der Beförderungsbedingungen, die Entschädigungen bei höherer Gewalt ausschließen, sind demnach ungültig.
